The Constitution allows five main types of writs:

A Special Leave Petition is a remedy under Article 136 of the Constitution. It allows an individual to appeal to the Supreme Court against a decision of any High Court, tribunal, or subordinate court, even if there’s no direct appeal provision. It is filed only with the Supreme Court’s discretionary permission.

SLPs can be filed in cases involving:

  • Miscarriage of justice

  • Substantial legal or constitutional issues

  • Wrongful High Court judgments

  • Lack of proper hearing or procedural fairness

  • Writ Petition: Ideally within a reasonable time, generally within 90 days from the cause of action.

  • SLP: Must be filed within 90 days of the High Court’s judgment or 60 days if a review petition was rejected.

Yes, you can file a writ petition under Article 32 directly in the Supreme Court if your fundamental rights are violated, but usually, it’s advisable to first approach the High Court under Article 226, which has broader powers (even for legal rights).
